These Terms of Service ("Terms") are a legal agreement between you ("user", "you") and DiseñaYAI ("we", "us"), currently operated as a personal project by an individual developer based in the United States. By accessing or using our service, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. 2. The service 2. El servicio

DiseñaYAI is an AI-powered virtual staging platform that allows users to upload photographs of interior or exterior spaces and receive AI-generated renders showing those spaces furnished or decorated in various styles. The service is provided "as is" and may include features like render history, account management, and style selection. DiseñaYAI es una plataforma de virtual staging con IA que permite a los usuarios subir fotograf\u00edas de espacios interiores o exteriores y recibir renders generados por IA que muestran esos espacios amoblados o decorados en diferentes estilos. El servicio se provee "tal cual" y puede incluir funciones como historial de renders, gesti\u00f3n de cuenta y selecci\u00f3n de estilos.

Beta status: DiseñaYAI is currently in beta. Features may change, be added, or removed without notice. Paid plans are not yet active. Estado beta: DiseñaYAI est\u00e1 actualmente en beta. 3. Your account 3. Tu cuenta

• You must provide accurate and complete information when registering. Debes proporcionar informaci\u00f3n precisa y completa al registrarte.
• You are responsible for maintaining the confidentiality of your password. Eres responsable de mantener la confidencialidad de tu contrase\u00f1a.
• You are responsible for all activity that occurs under your account. Eres responsable de toda la actividad que ocurra en tu cuenta.

4. Credits & plans 4. Cr\u00e9ditos y planes

Each AI render consumes one (1) credit. During the beta period, users receive 5 free credits per month. Credits reset on the first day of each calendar month and do not accumulate. When paid plans launch, subscribers will receive the number of credits specified in their chosen plan. Subscription terms, pricing, refund policy and billing cycles will be detailed separately at that time. Early waitlist members may receive discounts as communicated via email. 5. Your content 5. Tu contenido

You retain all rights to the photographs you upload to DiseñaYAI ("User Content"). By uploading content, you grant us a limited, non-exclusive, worldwide, royalty-free license to: Conservas todos los derechos sobre las fotograf\u00edas que subes a DiseñaYAI ("Contenido del Usuario"). • Store your content temporarily to provide the service. Almacenar tu contenido temporalmente para proveer el servicio.
• Display your uploaded and generated images back to you in your account. Mostrarte las im\u00e1genes que subes y las generadas en tu cuenta.

You represent and warrant that you own or have the necessary rights to the photographs you upload, and that uploading them does not infringe any third-party rights (copyright, privacy, publicity, etc.). 6. AI-generated renders 6. Renders generados con IA

Subject to your compliance with these Terms, you receive a commercial license to use the AI-generated renders for: Sujeto al cumplimiento de estos T\u00e9rminos, recibes una licencia comercial para usar los renders generados con IA en:

Due to the nature of AI generation, we make no guarantees regarding the uniqueness of any specific render. Similar inputs may produce similar outputs for different users. Debido a la naturaleza de la generaci\u00f3n con IA, no garantizamos la unicidad de ning\u00fan render espec\u00edfico. Inputs similares pueden producir outputs similares para diferentes usuarios.

7. Prohibited use 7. Uso prohibido

You agree NOT to use DiseñaYAI to: Aceptas NO usar DiseñaYAI para:

• Upload photos of properties you don't have permission to photograph or represent.Subir fotos de propiedades que no tienes permiso para fotografiar o representar.
• Generate content depicting real identifiable people without their consent.Generar contenido que represente a personas reales identificables sin su consentimiento.

• Attempt to reverse-engineer, decompile, scrape or copy the service.Intentar hacer ingenier\u00eda inversa, decompilar, scrapear o copiar el servicio.
• Use automated bots, scripts or scrapers to access the service.Usar bots, scripts o scrapers automatizados para acceder al servicio.
• Resell, sublicense or distribute access to DiseñaYAI without written permission.Revender, sublicenciar o distribuir el acceso a DiseñaYAI sin permiso escrito.

8. Service availability 8. Disponibilidad del servicio

We strive to keep DiseñaYAI available at all times, but we do not guarantee uninterrupted service. The service may be unavailable due to: Nos esforzamos por mantener DiseñaYAI disponible siempre, pero no garantizamos un servicio sin interrupciones. El servicio puede no estar disponible debido a:

AI rendering requests may occasionally fail due to model errors, content policy violations, or technical issues. Failed requests do not consume credits. By you: You may terminate your account at any time through the "Danger zone" section in Settings, or by emailing us. Termination deletes your data permanently and cannot be undone. • The service will be uninterrupted, timely, secure or error-free.El servicio ser\u00e1 ininterrumpido, oportuno, seguro o libre de errores.

11. Limitation of liability 11. Limitaci\u00f3n de responsabilidad

To the fullest extent permitted by law, DiseñaYAI and its operators shall not be liable for any indirect, incidental, consequential, special or punitive damages arising from or related to your use of the service, including but not limited to: loss of profits, loss of data, business interruption, or damages arising from using AI-generated content. Our total liability for any claim related to the service shall not exceed the total amount you paid to DiseñaYAI in the twelve (12) months preceding the claim, or US$100, whichever is less. You agree to indemnify and hold DiseñaYAI and its operators harmless from any claim, damage, loss or expense (including legal fees) arising from: (a) your violation of these Terms, (b) your use of the service in violation of applicable laws, (c) content you upload, or (d) infringement of third-party rights by your use of the service. These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration in Delaware, except where prohibited by applicable consumer protection laws in your jurisdiction. Before filing any legal action, you agree to first contact us at disenayai24@gmail.com and attempt in good faith to resolve the dispute informally. 14. Changes to these terms 14. Cambios a estos t\u00e9rminos

We may modify these Terms at any time. When we do, we'll update the "Last updated" date at the top. Material changes will be communicated via email or a notice on the service at least 14 days before they take effect. Continued use of DiseñaYAI after changes means you accept the updated Terms.
